General Terms and Conditions

(Effective from november 22, 2024)

Introduction

1.1. These General Terms and Conditions (hereinafter referred to as „GTC”) contain the terms and conditions of using the services provided by Be Kind Studio (Operator: Betfer Kft., registered office: 1098 Budapest, Napfény utca 40., Company Registration Number: 01-09-718794, Tax Number: 13102092-2-43, represented by: Bettina Szabó, email: hello@bekindstudio.hu), as the Service Provider (hereinafter referred to as „Service Provider” or „Studio”), and the rights and obligations of the Service Provider and the Customer (hereinafter collectively referred to as „Parties”).
1.2. By using any service, the Customer accepts the terms of this GTC. The Parties acknowledge these GTC as binding.
1.3. For any undefined terms, the rules of Act V of 2013 on the Civil Code (hereinafter referred to as „Civil Code”) apply.
1.4. The Service Provider exclusively concludes agreements based on this GTC.

 

Definitions

2.1. Service Provider (Seller): Be Kind Studio and the operator of the website www.bekindstudio.hu. Operator: Betfer Kft., registered office: 1098 Budapest, Napfény utca 40., Company Registration Number: 01-09-718794, Tax Number: 13102092-2-43.

2.2. Customer (Buyer): Any person submitting a purchase offer via the Service Provider’s website or in person, entering into a contract by initiating a purchase, and any customer purchasing a service or product on-site.
2.3. Parties: Collectively the Service Provider (Seller) and the Customer (Buyer).
2.4. Services: The Service Provider offers single-session Reformer Pilates classes, multi-session Reformer Pilates passes, and other related services to its customers. Details of the schedule and related services can be found on the Service Provider’s website and on the information boards displayed at the Studio. Related services include, but are not limited to, clothing for Reformer Pilates sessions and other movable goods marketed and sold by the Service Provider, which may form the subject of this Agreement.
2.5. Booking Fee: Customers with a pass will have one session deducted from their pass upon booking. Customers purchasing a single-session ticket can pay for the class in advance via the MotiBro system. The Service Provider reserves the right to deviate from the booking fee policy in favor of the Customer, as detailed on the Service Provider’s website and on the on-site information boards.
2.6. Service Location: Rózsadomb Center, 1025 Budapest, Törökvész út 87-91., 3rd floor.

 

Registration and Booking

3.1. The Service Provider requires prior registration and appointment booking to attend Reformer Pilates classes.
3.2. Registration and appointment booking for Reformer Pilates classes can be done through the Service Provider’s website (www.bekindstudio.hu) using the MotiBro application.
3.3. The Service Provider allocates places for customers based on the order of bookings received.
3.4. A booking is valid only when confirmed by the MotiBro system via email to the Customer.
3.5. Bookings for Reformer Pilates classes and passes are non-transferable to third parties.

 

Payment Terms

4.1. Service prices are available on the Service Provider’s website and on-site information boards.
4.2. Payment can be made via bank card online, bank transfer, or in cash.
4.3. Fees for Reformer Pilates classes and passes must be paid in advance via online bank card payment.
4.4. On-site payments can be made via bank card, bank transfer, or in cash.
4.5. Online bank card payments are processed through Stripe, Inc. Card data is not accessible to the merchant. Stripe Payments Europe is registered as an authorized electronic money institution with the Central Bank of Ireland under authorization number C187865. By using this service, you accept Stripe’s Privacy Policy, accessible at: https://stripe.com/privacy.
4.6. Customers may also settle service fees via bank transfer to the Service Provider’s K&H Bank account: HU25 1040 3136 5052 7077 8290 1005.

 

Cancellation Policy

5.1. If the Customer cancels their booking within 24 hours before the start of the Reformer Pilates class, the Service Provider will not refund the booking fee.
5.2. If the Customer cancels more than 24 hours before the class, the cancellation is free of charge, and the booking fee will be refunded.
5.3. Refunds for passes and prepaid classes are not possible unless medical certification is provided.
5.4. Multi-session passes must be used within their validity period, and any unused sessions will not be refunded after expiration.

 

Health Declaration and Liability

6.1. The Customer declares that their health allows them to participate in Reformer Pilates classes and perform the exercises safely.
6.2. The Customer acknowledges that during pregnancy or after childbirth, participation in Reformer Pilates classes is only allowed with medical approval and at their own risk.
6.3. The Customer acknowledges that all exercises are performed at their own risk.
6.4. The Customer accepts that the Service Provider is not liable for injuries, health damages, or medical issues occurring during Reformer Pilates classes or on the premises.

 

Code of Conduct

7.1. Customers must comply with the Studio’s rules and follow the instructor’s directions during classes.
7.2. The Be Kind Studio premises are private property. Equipment and services must be used as intended and in accordance with the Studio’s rules.
7.3. The Service Provider reserves the right to exclude customers from classes or premises if they violate the above provisions.

 

Data Protection

8.1. The Service Provider, as Data Controller, processes personal data in compliance with the Hungarian Act CXII of 2011 on Informational Self-Determination and Freedom of Information, the EU General Data Protection Regulation (GDPR), and other applicable data protection laws.
8.2. The Service Provider provides information on its data processing practices in the Privacy Policy, available to Customers and visitors of www.bekindstudio.hu.

 

Final Provisions

9.1. For matters not regulated in this GTC, the applicable provisions of Hungarian law, particularly the Civil Code, shall prevail.
9.2. This GTC enters into force on November 22, 2024, and remains valid until revoked.
9.3. The Service Provider may unilaterally amend the GTC, notifying Customers within a reasonable time in advance via the website and on-site notices.
